BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

In seinem Beitrag versucht der Verfasser, im Rahmen der philosophischen Systematik Bonifac Badrovs, des langjährigen Philosophie-Professors an der Franziskanische Theologischen Fakultät in Sarajevo, sein scholastisch-neuscholastisches Wahrheitsverständnis als adaequatio intellectus et rei, das ihm als der Leitfaden für seine Konzeption „Wissenschaftsphilosophie“, mit besonderer Berücksichtigung seiner Auffassung der „Begriffsbildung“. Dabei wird den Vorgang der Begriffsbildung durch die Definitionen als Bedeutungsbeschreibungen geschildert. Dadurch verliert der Begriff seine Verankerung in der unimittelbaren menschlichen Existenz, d.h. er wird weder als das Ergebnis des complicatio und explicatio (...) Verhältnisses (N. Cusanus) noch als der Vollzug der Selbstgewinnung des Menschen in eigener Existenz verstanden (H.-G. Depuis le début des années 2000, de nouveaux groupes miliciens ont émergé à la frontière mexicanoaméricaine, s’opposant à l’immigration illégale. Antifédérales, ils construisent un discours de l’immigrant amoral et a-éthique. Prônant un repli identitaire, ils s’inscrivent dans le mouvement anti-immigration californien et, plus largement, dans le backlash des années 1980. Il s’agit ici de s’intéresser au concept de frontière sociale et morale dans le cadre d’une anthropologie des groupes de vigilantism et de se demander de quoi la frontière est-elle le (...) lieu. Comment le mur est-il réactivé dans ces groupes comme support à une définition identitaire raciale?Since 2000, new vigilante groups have emerged at the US/Mexico border to oppose illegal immigration. The discourse constructed by these anti-federalist groups revolves around immigrants as amoral and devoid of ethics. Advocating a return to identity-based boundaries, they are an expression of the Californian anti-immigration movement and, more broadly, the backlash of the 1980s. This article delves into the concept of social and moral boundaries through an anthropological study of vigilante groups, and asks what resides within the space represented by borders. The Toulmin model has been proved useful in law and argumentation theory. This model describes the basic process in justifying a claim, which comprises six elements, i.e., claim (C), data (D), warrant (W), backing (B), qualifier (Q), and rebuttal (R). Specifically, in justifying a claim, one must put forward ‘data’ and a ‘warrant’, whereas the latter is authorized by ‘backing’. The force of the ‘claim’ being justified is represented by the ‘qualifier’, and the condition under which the claim cannot be (...) justified is represented as the ‘rebuttal’. To further improve the model, (Goodnight, Informal Logic 15:41–52, 1993) points out that the selection of a backing needs justification, which he calls legitimation justification. However, how such justification is constituted has not yet been clarified. To identify legitimation justification, we separate it into two parts. One justifies a backing’s eligibility (legitimation justification 1 ; LJ 1 ); the other justifies its superiority over other eligible backings (legitimation justification 2 ; LJ 2 ). In this paper, we focus on LJ 1 and apply it to the legal justification (of judgements) in hard cases for illustration purposes. We submit that LJ 1 refers to the justification of the legal interpretation of a norm by its backing, which can be further separated into several orderable subjustifications. Taking the subjustification of a norm’s existence as an example, we show how it would be influenced by different positions in the philosophy of law. Taking the position of the theory of natural law, such subjustification is presented and evaluated. This paper aims not only to inform ongoing theoretical efforts to apply the Toulmin model in the legal field, but it also seeks to clarify the process in the justification of legal judgments in hard cases. It also offers background information for the possible construction of related AI systems. In our future work, LJ 2 and other subjustifications of LJ 1 will be discussed. (shrink)

In this paper, I examine some of the most important theories of modern physics that support the notion that events are the basic ontological units of reality. The two main themes of this paper include: (1) physical evidence in support of an ontology of events, and (2) the increasing unification of physical theory until we arrive at the current state of two highly successful theories that are presently disunified within the search for a comprehensive, unified theory. With the revolutionary developments (...) in physics at the end of the nineteenth century, the mechanistic materialism of Newtonian physics began to break down and the ancient trinity of space, time and matter has been gradually replaced by the notion of the energy field. Physicists and philosophers who have held an event ontology specifically for its compatibility with electromagnetism, relativity theory and quantum mechanics include: Albert Einstein, Alfred North Whitehead, Bertrand Russell, C. D. Broad, W. V. Quine, John Bell, Henry Stapp, and Milič Čapek among many others. For these theorists, events are the most fundamental entities of physical reality in contrast to the Aristotelian tradition which contends that events are secondary or dependent on physical substance. Alors que dans la majorité des démocraties libérales le mandat d’élu·e au législatif national est rempli à plein temps depuis la fin du XIX e siècle, les membres de l’Assemblée fédérale en Suisse exercent leur fonction comme une charge à temps partiel faiblement indemnisée, dite de « milice ». Notre article illustre comment le principe de milice, véritable norme culturelle dominante de l’engagement public, a influencé les temporalités du travail parlementaire. Liber de orbe, attributed to Māshā'allāh (d.c.815), a court astrologer of the Abbasid dynasty, was one of the earliest Latin sources of Aristotelian physics. Until recently, its Arabic original could not be identified among Arabic works. Through extensive examination of Arabic manuscripts on exact sciences, I found two manuscripts containing the Arabic text of this Latin work, although neither of them is ascribed to Māshā'allāh: Berlin, Staatsbibliothek zu Berlin, Ms. or. oct. 273, and Philadelphia, Pennsylvania University Library, MS LJS 439. In this paper, I describe these two manuscripts in great detail, so that I confirm their originality of theLiber de orbe, and then by analysing the contents of the Arabic text, I deny the attribution to Māshā'allāh, and identify the title and author asBook on the Configuration of the Orbby Dūnash ibn Tamīm, a disciple of Isaac Israeli (c.855–c.955). This volume includes Felix Noeggerath's dissertation from 1916, published here for the first time in a reliable critical edition. The dissertation represents a daring and far-reaching re-conceptualization of Kantian and neo-Kantian thought that consists in "critique of anti-rationalism," especially in the form of vitalism. Both Kant's and Hermann Cohen's philosophies can be experienced anew through the far-reaching optic that Noeggerath developed - an optic that he reiterates and develops into a comprehensive theory of art in a 1951 essay - republished (...) here, as well. The introduction by Hartwig Wiebebach provides an overview and incisive analysis of Noeggerath's philosophical program, while the afterword by Peter Fenves describes in detail the effect of Noeggerath's thought on Walter Benjamin's own attempts at a critique of anti-rationalism. Altogether, the volume provides a new point of access to the important legacy of neo-Kantian thought in the early twentieth century not only in terms of the systematic philosophy, but also in relation to the theory of art and the philosophy of modern science. Screening programmes are becoming increasingly popular since prevention is considered 'better than cure'. While earlier diagnosis may result in more effective treatment for some, there will be consequent harm for others due to anxiety, stigma, side-effects etc. A screening test cannot guarantee the detection of all 'abnormal' cases, therefore there will be false reassurance for some. A proper consideration of the potential benefit and harm arising from screening may lead to the conclusion that the programme should not be offered. A (...) modified utilitarian approach may be used for allocation of scarce resources in health care. Ethics has an important role in this evaluation. (shrink)

I discuss a tension between two broadly Aristotelian ideas about the role of emotions in virtue and consider its implications for the original and attractive theory of virtuous judgment that Gopal Sreenivasan develops in Emotion and Virtue. One is the idea that a virtuous person has fitting emotions. The other idea is that the virtuous person has emotions that point her toward performing a virtuous action. I explain the tension between these ideas, and how it arises with respect to both (...) of Sreenivasan's central examples of virtue: compassion and courage.I suggest that this tension generates some interesting and systemic respects in which a virtuous agent's virtuous emotional responses hamper her attempts to judge what is the virtuous thing to do. This makes me less sanguine than I take Sreenivasan to be about the contributions of emotion to the virtuous agent's reliability in passing his “Central Test of Virtue.”. (shrink)

The editor has assembled these essays to support the thesis that Bergson considered "conceptual revolutions in physics inevitable [and that he foresaw] certain of their most important theoretical consequences." He introduces the collection with an intellectual biography indicating that, far from being antiscientific, Bergson was a respectful and diligent student of science. Several themes illustrative of the thesis run through the selections. One: Bergson's dualisms should be thought of as complementary, for example, intellect and intuition should be regarded as two (...) forms of empiricism rather than as antithetical approaches to knowledge. Another: Bergson anticipated concepts of quantum physics, such as, the dynamic concept of matter and the complementarity of velocity and position. A third theme: Bergson's ideas are suggestive for future scientific investigation, for example, the speed of light may be thought of as a coefficient of equivalence between space and time, a first law of time analogous to the first law of thermodynamics; then Bergson's concepts are perhaps a challenge to develop a second law. Most of the essays, originally published at various times between 1922 and 1959, appear in English for the first time. They are presented in four groups: "Quantum Physics" in which L. de Broglie, S. Watanabe, O. Costa de Beauregard, and R. Blanché are concerned with concepts of motion, entropy, and time; "Relativity" in which appears material by Bergson, Einstein, and Metz on Bergson's criticism of relativity, and essays by G. Pflug, J. F. Busch, W. Berteval, and O. Costa de Beauregard on aspects of Bergson's attack on relativity; "Bergson's and Zeno's Paradoxes" in which D. A. Sipfle uses an analysis of The Arrow by V. C. Chappell to interpret Bergson's theory of time. Milic Capek sums up the volume in an essay arguing that Bergson's concept of psychologic existence, on which his theory of matter is based, suggests a transformation of the basic concepts of the physical sciences. The concept of quantum principle is introduced as a principle whose formulation is based on specific quantum ideas and notions. We consider three such principles, viz, those of quantizability, local gauge symmetry, and supersymmetry, and their role in the development of the quantum field theory (QFT). Concerning the first of these, we analyze the formal aspects and physical contents of the renormalization procedure in QFT and its relation to ultraviolet divergences and the renorm group. The quantizability principle is formulated as (...) an existence condition of a self-consistent quantum version with a given mechanism of the field interaction. It is shown that the consecutive (from a historical point of view) use of these quantum principles puts still larger limitations on possible forms of field interactions. (shrink)

Tacitus writes that, by insisting that legionary legates who had not so far held the praetorship should immediately proceed to that office, Asinius Gallus ‘altius penetrare et arcana imperii temptari’. In C.Q. N.S. xvi , 327, I suggested that this demand of Gallus’ was probably probing dangerously deeply into and perhaps threatening to wreck the carefully worked-out imperial promotions system, the working of which has been examined by Birley. It is the purpose of this note to look at a number (...) of examples of such irregularity, which, though not as early as the debate during the course of which Gallus made his suggestion, do at least illustrate the process later in the Julio-Claudian era. In his historical writings, Cluvius Rufus evidently found cause to criticize Verginius Rufus for his conduct on a particular occasion ‘Scis, Vergini, quae historiae fides debeatur; proinde, si quid in historiis meis legis aliter ac velles, rogo igmoscas’. From his reply, it is clear that Verginius automatically understood Cluvius to be referring to an event to which he himself attached great significance: ‘Tune ignoras, Cluvi, ideo me fecisse, quod feci, ut esset liberum vobis scribere quae libuisset?’.

Antimicrobial resistance (AMR) poses an increasing threat to patient care and population health and there is a growing need for novel therapies to tackle AMR. Bacteriophage (phage) therapy is a re-emerging antimicrobial strategy with the potential to transform how bacterial infections are treated in patients and populations. Currently, in the UK, phages can be used as unlicensed medicinal products on a ‘named-patient’ basis. We make an ethical case for why it is crucially important for the UK to invest in Good (...) Manufacturing Practice (GMP) for both ongoing unlicensed and future licensed phage therapy. Access to phages produced to GMP (GMP phages) will ensure effective patient care and better outcomes as well as health systems benefits. The UK also has the potential to become a global leader in the timely and cost-efficient manufacturing and supply of a therapy that meets internationally recognised standards. (shrink)

To commemorate 40 years since the founding of the Journal of Business Ethics, the editors in chief of the journal have invited the editors to provide commentaries on the future of business ethics. This essay comprises a selection of commentaries aimed at creating dialogue around the theme Technology, Megatrends and Work. Of all the profound changes in business, technology is perhaps the most ubiquitous. There is not a facet of our lives unaffected by internet technologies and artificial intelligence. The Journal (...) of Business Ethics established a dedicated section that focuses on Technology and Business Ethics, yet issues related to this phenomenon run right through all the sections. Kirsten Martin, editor of the Technology and Business Ethics section, joins our interim social media editor, Hannah Trittin-UIbrich, to advance a human-centric approach to the development and application of digital technologies that places Business Ethics at centre of the analysis. For Shuili Du, technology is the defining condition for a new era of Corporate Social Responsibility—CSR 3.0—which she defines as “a company’s socially responsible strategies and practices that deal with key ethical and socio-technical issues associated with AI and related technologies on the one hand and leverage the power of AI and related technologies to tackle social and environmental problems on the other hand.” It is not just technologies that are a determining feature of our lives but technology companies, an argument made by Glen Whelan as he examines Big Business and the need for a Big Business Ethics as we try to understand the impact of Big Tech on our post-work world. Indeed, as noted by Ernesto Noronha and Premilla D’Cruz, megatrends in addition to advancement in technologies, namely globalization, the greening of economies, and changes in demographics and migration, are shaping the future for workers in ways previously unimaginable. Contributing to this important debate, Praveen Parboteeah considers the influence of another longstanding but oft overlooked megatrend, the role of religion in the workplace. Given the enormity of the influence of technology and other megatrends in our world, it is not surprising that this essay introduces ground-breaking ideas that speak to the future of business ethics research. Emotion can be communicated through multiple distinct modalities. However, an often-ignored channel of communication is posture. Recent research indicates that bodily posture plays an important role in the perception of emotion. However, research examining postural communication of emotion is limited by the variety of validated emotion poses and unknown cohesion of categorical and dimensional ratings. The present study addressed these limitations. Specifically, we examined individuals’ (1) categorization of emotion postures depicting 5 discrete emotions (joy, sadness, fear, anger, and disgust), (2) (...) categorization of different poses depicting the same discrete emotion, and (3) ratings of valence and arousal for each emotion pose. Findings revealed that participants successfully categorized each posture as the target emotion, including disgust. Moreover, participants accurately identified multiple distinct poses within each emotion category. In addition to the categorical responses, dimensional ratings of valence and arousal revealed interesting overlap and distinctions between and within emotion categories. These findings provide the first evidence of an identifiable posture for disgust and instantiate the principle of equifinality of emotional communication through the inclusion of distinct poses within emotion categories. Additionally, the dimensional ratings corroborated the categorical data and provide further granularity for future researchers to consider in examining how distinct emotion poses are perceived.
